In the final quarter of 2022 the township advertised RFPs and interviewed for various professional services in the township including Planner, Engineer and Solicitor. Over the first quarter of 2023 the committee has spent much time diligently reviewing the needs of the community to choose the best professionals. Some of those concerns include containing costs as well as upcoming Storm Water Management rules coming forth from the state.
January 29, 2023 the township committee passed resolution 2023-1-29 naming LFB Land Planning as the township planner replacing CME Associates. Environmental Resolutions, Inc was replaced by Roberts Engineering Group as the township engineer via resolution 2023-1-18 although Joe Hirsch of Environmental Resolutions, Inc. will remain to oversee the completion of the pickleball project at Fenton Lane Park. Resolution 2023-1-21 appointed Evan Crook of Malamut & Associates LLC as the township Labor Attorney.
RFPs for township solicitor faced controversy amongst the committee after initial interviews were completed and decisions were to be made. After discussion, the township committee voted to reissue new RFPs for the township solicitor position and following interviews of the three qualified applicants in March the committee unanimously voted to replace John C. Gillespie, Esq. of Parker McKay with Dominic P. DiYanni, Esq. of Eric M. Bernstein & Associates, LLC via resolution 2023-3-7.
While Mr. Gillespie is no longer the township’s solicitor, that same meeting, the committee approved Resolution 2023-3-12 a Resolution Authorizing Execution of Amendment to Escrow Agreement with Active Acquisitions OY LLC and Resolution 2023-3-13 Resolution Authorizing Joint Defense Agreement to Defend Litigation Pending in the Superior Court of New Jersey, Law Division, Entitled “Save Old York, et al V. Township of Chesterfield, et al Docket No Bur-L-002322-22. The escrow amendment was made to the original escrow account Ordinance 2022-2022-15 and Ordinance 2022-17 to reflect the committees acceptance of Active Acquisition’s offer of covering litigation costs of a Zoning Appeal case brought against the township, Save Old York, et al. vs Township of Chesterfield, et al. Active Acquisition’s offer to cover the litigation costs were conditional on that the township allow Mr. Gillespie of Parker McKay to continue to be retained to represent the township for the litigation. Active Acquisitions was not a named as a defendant in the original zoning appeal suit, however, they voluntarily joined as an intervenor/defendant and will continue to also have their own assigned attorney/attorneys to represent their individual interests who are only beholden to loyalty to the client they represent within the suit.
At the end of March 2023 some residents received a notice from Richard J. Hoff, Jr. Esq, attorney for Active Acquisitions OY, LLC, that the Chesterfield Township Planning/Zoning Board will hold a public hearing on April 18, 2023 at 7:00pm on the application of Active Acquisitions OY, LLC for preliminary and final major site plan approval for properties designated as Block 701, Lots 2.01 and 1.02 also commonly known as 228 Old York Road and 222 Old York Road. There has not been a public meeting on these plans made to the public to date.
Active Acquisitions is seeking preliminary and final major site plan approvals for the construction of a single warehouse, distributing and/or wholesaling with associated parking and loading areas, signage as well as other supportive infrastructure. the building project will be approximately 1,135,260 sq feet of building development. the application proposes 556 parking spaces, 216 loading spaces, and 255 trailer parking spaces associated with the warehouse. the applicant is also seeking approval of the construction of a water tank and waste water treatment building.
The applicant is also looking to gain approval for their proposal to relocate the existing historic structure known as both the 1740 Black House and the Decker House off of lot 2.01 onto lot 1.02, approximately 685 feet from its present location. Along with moving the historic home they are asking to add to lot 1.02 a 14 space parking lot and a new driveway to serve both the relocated historic home and the existing single-family dwelling on Lot 1.02. They are also proposing to change the use of the 1740 Black House from residential to office.

Special Planning Board Meeting to Hear Application
The Chesterfield Township Planning/Zoning Board has added a Special Meeting to their schedule for April 25, 2023 at 7:00pm to hear the application of AAJ Chesterfield, LLC regarding Block 1102 Lot 6.02 regarding a minor site plan. The lot commonly known as 745 Monmouth Rd, Chesterfield is currently zoned as residential.
